1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS - Please note the following things as you will notice them quite often in these terms: When you see the words "our service" in these Terms, it refers to everything we do in regard to our Search Engine Optimisation service, which includes submitting to search engines, directories and link lists. When you see in these terms the words "purchaser" or "registrar", we are referring to the person who registers their web site for our website Search Engine Optimisation service. The "purchaser" or "registrar" is the person who buys our Search Engine Optimisation service. By completing our registration process for our Search Engine Optimisation service, you are indicating your agreement to be bound by these terms. In the event that you do not accept these terms, you are not authorised to use this service.
2. SEARCH ENGINE OPTIMISATION SERVICE REGISTRATION - If the purchaser orders one of our search engine optimistion services, the purchaser will be sent an email notification of the amount of the charge and any other pertinent information on this service. After confirming the purchaser's payment, the customer will need to complete the registration process, which includes providing us with a list of key phrases and other details in regard to your website. Within three (3) business days, the purchaser will receive an email or a fax that includes an "Authorisation Form" that needs to be agreed to, signed and faxed back to (02) 9801 2800 for us to begin work on optimising the purchaser's website.
3. OUR GUARANTEE - For our Search Engine Optimisation service, we
guarantee that at least two (2), three (3) or five (5) agreed upon key phrases (depending on the package chosen) will appear on the first page of at least three (3) major search engines within a specified timeframe. It can take as little as 8 weeks to as much as 16 weeks, from the date of optimisation, for the site to hit the first page with the terms of our guarantee. One of the major search engines must be either Yahoo or Google. Details of the guarantee are outlined in the "Authorisation Form" that will be sent to the purchaser prior to the start of the optimisation service. The purchaser and/or registrar must direct all questions regarding this matter to seo@premierweb.net.au.
4. REFUNDS - Under no circumstance do we offer a refund on our Search Engine Optimisation service unless section 3 of these terms applies.
5. WE ARE NOT LIABLE FOR ANYTHING - In no event shall Premier Web Services and/or any of our associates be liable for any loss, including loss of income, damage or injury of any nature, whether direct, indirect, incidental, punitive, special and/or consequential, in connection or resulting from the information, download, broadcasting, and/or submission provided by Premier Web Services. Premier Web Services and/or any of our associates does not accept any responsibility for any liabilities resulting from the actions of any parties involved.
6. INDEMNIFICATION - The purchaser and/or registrar agrees to indemnify and hold Premier Web Services, its associates and employees, harmless from any claim or demand, including reasonable solicitor's fees, made by any third party due to or arising out of the purchaser's and/or registrar's use of any of our services, the violation of the terms by the purchaser and/or registrar, or infringement by the purchaser and/or registrar of any intellectual property or other right of any person or entity.
7. MORAL CLAUSE - The purchaser and/or registrar agrees not to submit any web sites that are pornographic, racists, violent or websites that infringe on the rights of others. The purchaser and/or registrar agrees not to submit any web site(s) that is illegal in any way, shape or form. Premier Web Services reserves the right to refuse service at any time by simply notifying the purchaser and/or registrar via email and refunding any payments made.
8. TRADEMARKS - All of the search engine and directory names and logos listed on the Premier Web Services' website are trademarks and/or service marks of their respective owners (e.g. the Google logo - obviously belongs to Google).
9. CANCELLATION - The purchaser and/or registrar agrees if cancelling for any reason, including asking, receiving, and/or accepting a refund, discontinuing the service after the 12 month expiration date, and/or disputing a charge against Premier Web Services, this automatically authorises us to discontinue the purchaser's and/or registrar's service/account and remove any applicable web site(s) from all possible search engines.
10. SERVICE REFUSAL - We reserve the right to refuse service.
